Terms of purchase

These terms and conditions apply to purchases of goods from tasseladden.no.

The purchase of goods online is regulated, among other things, by the Contracts Act, the Consumer Purchase Act, the Right of Withdrawal Act, the Marketing Act, and the E-commerce Act. These laws grant the consumer inalienable rights. The terms and conditions here should not be interpreted as limiting these rights, but rather describe the parties' main rights and obligations when shopping in the online store.

The terms of sale are based on and recommended by the Norwegian Consumer Authority.

1. Agreement

The agreement consists of these purchase terms, information provided in the ordering solution, and any specifically agreed-upon terms.

In case of any conflict between information provided in the ordering solution and these terms, what has been specifically agreed upon between the parties shall take precedence, provided it does not conflict with mandatory legislation.

The buyer is the consumer who places the order and is hereinafter referred to as the buyer.

3. Price

The stated price for the goods and services is the total price the buyer must pay. This price includes all taxes and additional costs. Any additional costs not disclosed by the seller before the purchase shall not be borne by the buyer.

4. Conclusion of Agreement

The agreement is binding for both parties when the buyer has sent their order to the seller.

However, the agreement is not binding if there have been writing or typing errors in the seller's offer in the ordering solution or in the buyer's order, and the other party realized or should have realized that such an error existed.

5. Payment

The seller may demand payment for the goods from the time the goods are dispatched from the seller to the buyer.

If the buyer pays by card, the seller may reserve the purchase amount upon ordering. The card will be charged on the same day the item is shipped.

When paying by invoice, the buyer's invoice will be issued upon shipment of the item. The payment deadline is stated on the invoice and is a minimum of 14 days from receipt.

Buyers under 18 years of age cannot pay by subsequent invoice.

6. Delivery

Delivery has occurred when the buyer, or the buyer's representative, has taken possession of the item.

If the delivery time is not stated in the ordering solution, the seller shall deliver the item without undue delay and no later than 30 days after the order.

7. Risk for the Product

The risk for the product transfers to the buyer when the product has been delivered in accordance with the delivery clause.

8. Right of Withdrawal

The buyer can cancel the purchase of the item in accordance with the Right of Withdrawal Act.

The withdrawal period is 14 days from the day after the item is received.

If the purchase consists of multiple deliveries, the deadline runs from the day after the last delivery is received.

The buyer must notify the seller of the use of the right of withdrawal within the deadline. For evidentiary reasons, the notification should be in writing.

When exercising the right of withdrawal, the item must be returned without undue delay and no later than 14 days after notification of the right of withdrawal has been given.

The buyer covers the costs of return, unless otherwise agreed.

The seller shall refund the purchase price no later than 14 days after receiving notification of withdrawal, but may withhold payment until the item has been received or documentation of return has been provided.

9. Delay and Non-delivery

If the seller does not deliver the item at the agreed time, and this is not due to the buyer, the buyer may, according to the Consumer Purchase Act, among other things:

  • withhold the purchase price
  • demand fulfillment
  • cancel the purchase
  • claim compensation

10. Defect in the Item

If there is a defect in the item, the buyer must notify the seller within a reasonable time after the defect was discovered.

The buyer has always complained in time if a complaint is made within two months after the defect was discovered.

The complaint period is two years after the item is received, or five years if the item is intended to last significantly longer.

In case of a defect, the buyer may, depending on the circumstances, demand:

  • rectification
  • redelivery
  • price reduction
  • cancellation
  • compensation

11. Seller's rights in case of buyer's breach

If the buyer does not pay or fulfill their obligations under the agreement, the seller may, under the Consumer Purchases Act, among other things:

  • withhold the item
  • demand fulfillment
  • cancel the agreement
  • claim compensation

In case of non-payment, the seller may claim interest in accordance with the Interest on Overdue Payments Act.

In case of non-payment, the claim may, after prior warning, be sent for collection. The buyer may then be held liable for fees under the Debt Collection Act.

12. Warranty

A warranty provided by the seller or manufacturer grants rights in addition to the rights the buyer already has under mandatory legislation.

13. Personal Data

The seller is the data controller for personal data.

Personal data is processed in accordance with applicable privacy regulations and is used only to the extent necessary to complete the purchase and fulfill the agreement.

14. Dispute Resolution

Complaints should be directed to the seller within a reasonable time.

The parties shall attempt to resolve disputes amicably. If this is not successful, the buyer can contact the Consumer Council for mediation.

If the matter is not resolved through the Consumer Council, it can be brought before the Consumer Disputes Committee.
